The applicant proposes to modify their Mined Land Reclamation permit to combine two separate permitted sites owned and controlled by the applicant into one Mined Land Reclamation facility. In addition, the proposal adds approximately 139.6 acres of sand, gravel and mineral reserves to the Life of Mine (LOM) of an existing 13.4 acre LOM sand and gravel mine, to total a ~153 acre LOM. The operation will continue the removal of in-situ sand and gravel, and material screening by portable equipment. The method of mineral extraction proposed will include standard drilling and and blasting, no more than two blasts per month, to create properly sized material that can then be processed by an onsite portable crusher. It is expected that the crusher(s) will require a NYS DEC Air Facility Registration. The project site is located on a contiguous 280.4 acre parcel of land adjacent on the west to NYS Routes 29 &10 in the Town of Ephratah, Fulton County.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Jun 12, 2009.
