Public Notice

Public Involvement Sessions

The New York State Department of Environmental Conservation, in conjunction with the United States Environmental Protection Agency, and the New York State Department of Health (Agencies) will be holding public involvement sessions regarding FMC Corporation's (FMC) completion of some off-site environmental investigations pertaining to their Middleport New York facility in Niagara County, as documented in FMC's Draft Environmental Report Volumes I, II & IV. The involvement sessions will be held:

Date: Wednesday, June 10, 2009
Times: 2:00 p.m. to 4:00 p.m. and 6:30 p.m. to 8:30 p.m.
Place: Middleport Fire Hall
28 Main Street
Middleport, New York

The afternoon session will be informal, where members of the public can ask questions of Agencies' staff and/or of FMC's personnel and its consultants, on a one-on-one basis regarding the content of the Draft Report volumes or other FMC environmental matters. The evening session will begin with brief presentations by FMC and the agencies, and then will be opened to members of the public to make verbal comments on the record. Also, written comments can be provided to the agencies during both the afternoon and evening sessions.

Written Comment Period: The agencies will also be accepting written comments from the public on the FMC Draft Environmental Report Volumes I, II & IV during a 45 day period which begins on May 18, 2009 and runs through July 2, 2009. Written comments should be submitted to:

Notice of Acceptance of Draft GEIS

Erie County - The Town of Tonawanda Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed North Youngman Commerce Center. Written comments on the Draft GEIS will be accepted until June 5, 2009. No Public Hearing will be held. A copy of the Draft GEIS is available at the Town of Tonawanda Building Department, 535 Belmont Avenue, Tonawanda, New York and may be viewed at the Town of Tonawanda Public Library - Kenmore Branch, 160 Delaware Road, Kenmore, New York; or on the Town's website at: www.tonawanda.ny.us.

The action involves the development of a commercial business park on approximately 92 acres of vacant, undeveloped land that is currently owned by the Town of Tonawanda. The project would include the construction of office and/or light industrial buildings and infrastructure (e.g. roads, parking lots, utilities, stormwater management facilities, etc.). The project may also involve the relocation of the existing Two Mile Creek pedestrian/bike path and widening of the bridge carrying East Park Drive over Interstate 290 to accommodate pedestrian and bicycle traffic associated with the path and traffic associated with the business park. The project is located north of I-290 and east of Two Mile Creek Road and East Park Drive (commonly known as the Mud Flats), Town of Tonawanda, New York.

Notice of Acceptance of Draft GEIS and Public Hearing

Niagara County - The City of Niagara Falls City Council, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Comprehensive Plan and Zoning Ordinance Amendments. A public hearing on the Draft EIS will be held on June 1, 2009 at 7:00 p.m. at the City of Niagara Falls Council Chambers, City Hall, 745 Main Street, Niagara Falls, NY 14302-0069. Written comments on the Draft EIS will be accepted until June 15, 2009. A hard copy of the Draft GEIS is available from the Niagara Falls City Clerk, 745 Main Street, Room 114, Niagara Falls NY 14301.

The action involves a recommendation by the Planning Board to the City Council for adoption of a new Comprehensive Plan and proposed amendments to the City of Niagara Falls Zoning Ordinance designed to implement the Comprehensive Plan. The proposed Plan is based upon citizen participation in an open planning process dating back until at least 2003. The general intent of the Plan is to guide the physical revitalization of City of Niagara Falls neighborhoods and districts and to foster economic development within the City. The project is located citywide in the City of Niagara Falls, New York.
