Project Description:

Goodyear Chemical Plant located in Niagara Falls has submitted an Air State Facility application requesting an operating permit under 6NYCRR, Part 201-5 and limiting facility-wide potential emissions to less than major source thresholds through production limits. Federally enforceable permit conditions will limit emissions of volatile organic compounds (VOC's) to less than 50 tons per year, total hazardous air pollutants (HAP's) to less than 25 tons per year, and individual HAP's xylene and diphenylamine, each to less than 10 tons per year. As a minor source, Goodyear will not be subject to the permitting requirements of, 6 NYCRR, Part 201-6 Title V and 40 CFR 63, Subpart FFFF Miscellaneous Organic Chemical Manufacturing National Emission Standards for Hazardous Air Pollutants. Emissions testing of the elimination tanks at current operating levels established a production limit of 3450 batches per year along with emission control equipment that would effectively limit facility emissions below major source thresholds. The Title V Permit set to expire in 2011will be rescinded when the Air State Facility Permit is issued.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jun 08, 2009.
