Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Clean Air Act Amendments, and made a tentative decision to approve this new permit for CH-Auburn Energy LLC's bio-energy facility located at 35 Bradley Street, Auburn, NY.

The facility consists of the construction and operation of a bio-energy facility, SIC code 4911. Specifically, the facility will be a 3MW (MegaWatt) renewable energy project to be constructed at the location of the Auburn Water Pollution Control Plant (WPCP) in the City of Auburn, New York and will be owned and operated by CH-Auburn Energy, LLC.

Upon completion, the facility will combust primarily the landfill bio-gas from the City of Auburn Landfill. Bio-gas from the landfill will be combusted to produce 3MW of renewable electricity and heat for use by the City of Auburn and businesses in the Auburn Technology Park. The emission sources at the facility include three generators (Jenbacher Model J320-GS-BL systems). The sulfur concentrations in the bio-gases generated from the landfill will be pre-treated in a closed loop desulfurization process to reduce the sulfur concentration in the bio-gas fuel.

In the event that the generators are not operated, such as during periods of maintenance activities, a valve in the landfill pipeline will be closed and the landfill gases will be flared at the landfill, which is currently permitted under the City of Auburn Landfill air permit (Permit ID: 7-0501-00042/00004).

This project is in coordination with a modification to the City of Auburn Landfill Gas Utilization Project, Part 360 Solid Waste Management Permit, Permit ID 7-0501-00095/00001, to make changes to the landfill gas system since the landfill gas will no longer be used, or only as a backup, to operate the City's WPCP incinerator, as mentioned above.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Applicant proposes approximately 500 feet of streambank stabilization along Sixmile Creek immediately adjacent to Valley Road in the hamlet of Brooktondale just downstream from Tompkins County highway bridge #1045990.

Project will include construction of a new steel sheet pile retaining wall approximately 286 feet in length to be installed at the bottom of the streambank. Slopes above the new wall will be recontoured and the area between the top of the retaining wall and the edge of Valley Road will be stabilized with temporary and permanent turf reinforcement and seeded.
