Project Description:

The proposal consists of a new, 4.8 acre sand and gravel mine. The site, located on the south side of Fye Road approximately 3,000 feet west of Church Road intersection, is part of a 99.7 acre parcel of land owned by Malcolm Fye III. All 4.8 acres have been previously disturbed. Mining will proceed in an easterly direction, yielding approximately 5,000 to 20,000 cubic yards of material per year, with an estimated total yield of 100,000 cubic yards. There will be no onsite processing. Upon completion of mining, the entire site will be reclaimed to establish grasses and eventually woody vegetation.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the existing Air Title V Facility permit for Indeck-Corinth, a fossil fuel fired electrical generating facility. The modification incorporates the requirements of the Federal Clean Air Interstate Rules (CAIR), 6 NYCRR Parts 243, 244, 245; and the New York State Regional Greenhouse Gas Initiative (RGGI) rule, Part 242. These regulations require that facilities obtain/possess at least as many `allocations' of oxides of nitrogen (NOx), sulfur dioxide (SO2) and carbon dioxide (CO2) as they emit into the atmosphere. An `allocation' is a unit of pollution which is limited by a budget established by these regulations. The DEC developed the CAIR regulations in response to the United States Environmental Protection Agency's (EPA) CAIR rules. The RGGI rule was developed in conjunction with nine other states in the region for the purpose of reducing emissions of CO2 by 10% between 2015 and 2018.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The Department (DEC) has prepared a draft permit and has made a tentative determination to approve the application that renews the existing Air Title V Facility permit for Great Meadow Correctional Facility. The facility is potentially a major source of emissions of sulfur dioxide and nitrogen oxides which are emitted from the boilers in their power plant. The renewal is basically unchanged from the current permit which expires August 24, 2009, and does not increase allowable emissions or impose additional regulations.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
