Project Description:

The applicant proposes to construct a Maitake mushroom production and processing facility to be located on a 47.8+/- acre property at the southeast corner of the intersection of NYS Route 209 and McDonald Road. Operation of the facility will require the withdrawal of up to 438,000 gallons per day (gpd) of groundwater for use in a geothermal heating and cooling system. This water will be discharged to an infiltration basin following the "once through " flow process. Approximately 95,000 gpd will be consumed during this process resulting in a flow of up to 343,000 gpd back into the infiltration basin. The Department has reviewed this process and determined that a State pollutant Discharge Elimination System (SPDES) permit is required and has made a preliminary determination that this discharge will meet regulatory standards. Accordingly, a draft permit has been prepared and is available for public review and comment. Sanitary wastewater (3,640 gpd design flow) from the facility will be discharged to a subsurface disposal system.

The Department has also reviewed a Stormwater Pollution Prevention Plan (SWPPP) prepared for the project and has made a determination that the plan complies with the requirements for coverage under the State`s General Permit for stormwater discharges. A Freshwater Wetlands permit is also required from the Department for the construction of a stormwater discharge outfall within the 100 foot adjacent area of state regulated wetland WU-11, class 3.

Project Description:

Mombaccus Excavating, Inc., has applied for a 5-year renewal and modification of its Mined Land Reclamation permit to merge two adjacent mines that it owns; the "Mombaccus Excavating Mine" (MLR# 30578) and the "Rochester Center Development Mine" (MLR# 30496) to become the "Rochester Center Road Mine." Both of the existing mines are owned by the applicant, Mombaccus Excavating, Inc., and the new combined mined will be operated as a single mine.

The applicant proposed the following modifications to create the single mine:

• mine the 13-acre middle ridge that currently separates the two mines,
• improve interior drainage by mining some sections of the mine 30 feet deeper,
• and eliminate one of the the existing mine entrance roads on Rochester Center Road.

The applicant does not propose any changes to the production, processing, mining and reclamation method, or to the hours of operation for this combined mine. The total approved acreage for the two existing mines is currently 88 acres. Mining the center ridge would add 13 acres, for a new total life-of-mine area of 101 acres, on a combined 269-acre property. All of the proposed 13-acre expansion is internal.

The two abutting mines are located on the south side of Rochester Center Road, immediately east of its intersection with Samsonville Road, in the Town of Rochester, Ulster County, NY.
