Project Description:

The applicant proposes to mine sand and gravel on 22.1 acres of land that is located adjacent to their currently Department Mined Land Reclamation Permitted Bull Pit (6.8 acres). The additional land consists of approximately 2.9 acres owned by Donald Bull, and approximately 19.2 acres owned by the applicant. Excavation below the ground water table is proposed on approximately 12 acres of the project site, resulting in a lake. Material processing will include use of a portable screen and/or crushing unit. The haulroad will be an existing driveway through Hanson Materials to State Route 60. The anticipated life of the expanded mine is 5 years or less, with reclamation activities to be completed within two years of final aggregate removal. The reclamation plan includes a 12 acre lake, and land suitable for agriculture. The project site is located approximately 1300 feet north of U.S. Route 20, 2200 feet east of State Route 60, 600 feet southeast of the NYS Thruway/Interstate 90 Interchange No. 59, and 900 feet west of Swamp Road, in the Town of Dunkirk.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit to Whiting Door Manufacturing Corp. for the facility located at 13550 Bloomingdale Road in the Town of Newstead. The facility has six emission points for process applications that include adhesive spray booth, burn-off oven, rust inhibitor bath, adhesive hot press and sawdust collection systems used in the making of metal springs and wooden panels. Under this permit, the facility will limit total VOC emissions to less than 10 tons per year and will not be subject to the control requirements of 6 NYCRR Part 228, Table 1.
