Project Description:

The proposed project involves modifications to an existing 160 acre unconsolidated sand and gravel mine. The mine has been in operation since 1966. The modifications consist of expanding the previously approved 13 acre pond in Phase 1 by 22 acres into Phases 7 and 8, and the removal of sand and gravel from an additional 7 acre area, which will include a 2.5 acre pond, located in the far western portion of the property, adjacent to Interstate 84 and the towns of Fishkill and East Fishkill landfill. The proposed total acreage for the life of mine is 167 acres on a 230 acre property controlled by the owner. Material processing (screening, wet-washing, part-time crushing) will continue at the existing plant; no mineral preparation or processing will take place in the proposed 7-acre expansion. The proposed reclamation objective for the site is open space with ponds.

The Department of Environmental Conservation (DEC) has made a tentative determination to modify existing State Pollutant Discharge Elimination System (SPDES) permit #NY0031739. This permit involves the surface discharge at a reduced flow limit of up to 112,000 gallons per day (gpd) as a monthly average instead of the current flow limit of 184,000 gpd. The treated sanitary waste has year-round disinfection prior to discharge to an unnamed Class C tributary of the Hudson River via one (1) outfall. A new Wastewater Treatment Plant at Chelsea Ridge Apartments property will replace the existing Wastewater Treatment Plant. A draft permit is available for inspection and comment at the DEC Region 3 Office.

Project Description:

The applicant proposes to modify a portion of Freshwater Wetland WF-10 (Class III) and its 100 foot adjacent area to construct a 2,285 square foot office building with new septic disposal system, water supply well and related improvements on a 5+acre site. Proposed activities within regulated areas of the wetland include construction of approximately 690 linear feet of dual 1.5" diameter sanitary force main, 320 linear feet of 1" diameter water supply piping, a new pump chamber and 1000 gallon septic tank, replacement of an existing culvert with new 24" by 38" elliptical culvert pipe, and excavation of the trench to install water supply and wastewater lines. The total area of disturbance to the wetland is 0.03-acre; the total area of disturbance to the adjacent area of the wetland is 0.14-acre. Approximately 0.48-acre of the adjacent area of the wetland will be enhanced by planting wetland vegetation as mitigation. The project is located on the east side of NYS Route 9D, 1/4 mile north of Stonekill Road in the Town of Wappinger, Dutchess County.

Metro Recycling & Crushing, Inc. has applied for a 5-year renewal of their Mine Land Reclamation permit for their existing 13.4 acre Phillipsport Mine and for two modifications to that permit.

The first modification would expand the footprint of the mine by 1.1 acres into a previously un-mined portion of a hill on the southern end of the mine, but still within the same 17.5 acre parcel of land owned by the applicant.

The second modification would expand the currently approved area for mining below the watertable from 5.1 acres up to a proposed 8.3 acres, but still in the central area of the mine. These modifications are not within 100 feet of any DEC regulated freshwater wetland or the Homowack Kill, nor will they disturb the nearby Delaware & Hudson Canal.

This mine is located on Phillipsport Road, across from Dugout Road, in the Town of Mamakating, Sullivan County, NY.
