Project Description:

Applicant proposes to construct a ferry terminal and boat basin to provide commuter ferry service to the Manhattan area and other future areas of interest. The portions of the proposed project that are under the jurisdiction of the NYSDEC are the excavation and dredging activities, removal and landward replacement of existing bulkheading and marine waterside improvements that include construction of in-water structures as part of the ferry landing area. The landward movement of the bulkhead and marine water-side improvements are proposed in order to accommodate two ferry vessels with capacities ranging from 140 to 175 passengers. The new bulkhead will be installed landward of the existing bulkhead in order to provide the required 52 feet of distance from the navigational channel to berth the proposed ferries. The site is located on the south side of Garvies Point Road approximately 1,500 feet west of Herb Hill Road and Dickson Street, Glen Cove, City of Glen Cove, Nassau County, NCTM# 21-259-1.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared draft permits and has made a tentative determination to renew the facility's Title V and Title IV permits. This facility consists of two 100 MW steam electric generators firing natural gas, two 50 MW Frame 7 combustion turbines and a 12.5 mmBtu/hr gas fired house boiler used to supply building heat and steam during start-up of the main boiler.
In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant proposes to remove remains of a bulkhead and concrete rip rap, install 101 feet of new bulkhead and two returns, and place 100 cubic yards of fill landward of the bulkhead. Placement of fill behind the new bulkhead which will be located seaward of apparent high water will result in the permanent loss of approximately 300 square feet of tidal wetlands known as littoral zone (LZ).
