Project Description:

The applicant proposes the renovation of an existing, abandoned railbed into a shared-use path. This phase, Phase III, consists of the following two sections of former railline:

  1. From Railroad Avenue in the hamlet of Hopewell Junction, Town of East Fishkill to NYS Route 376 (~0.25 mile) and
  2. From Lake Walton Road, Town of East Fishkill to Wappinger Creek at Manchester Bridge in the Town of La Grange and including portions within the Town of Wappinger (~ 6.1 miles).

This renovation requires rehabilitation and/or replacement of numerous culverts and one bridge with disturbances to NYS Freshwater Wetlands and Protected Streams. Disturbances are as follows, identification number and class are given for wetlands and name, NYS Waters Index Number (WIN), and class are given for all protected streams: For Section 1:

  • Trail construction, including minor re-grading and placement of fill, within the 100-foot Adjacent Areas of NYS wetlands HJ-19 (Class 1) and HJ-12 (Class 2)
  • Culvert wingwall repair within the bank of the Whortlekill, NYS WIN H-95-12, Class C(t)

For Section 2:

  • Trail construction, including minor re-grading and placement of fill, within the 100-foot Adjacent Areas of NYS wetlands HJ-72 (Class 3), HJ-3 (Class 2), HJ-4 (Class 2), PV-45 (Class 2), PV-67 (Class 2), and PV-32 (Class 2).
  • Repairs, including installation of riprap, to an existing bridge over Sprout Creek, NYS WIN H-95-10, Class C(t).
  • Installation of a new culvert to re-establish the original course of an unnamed tributary of the Wappinger Creek, NYS WIN H-101-4, Class B(t) within the Adjacent Area of wetland HJ-3.
  • Repair existing culvert in an unnamed tributary of the Wappinger Creek, NYS WIN H-101-4-5, Class B.
  • Replacement of an existing culvert in an unnamed tributary of the Wappinger Creek, NYS WIN H-101-4-4, Class B and within wetland PV-45.
  • Replacement of an existing culvert in an unmapped sub-tributary of the Wappinger Creek within wetland PV-45.
  • Rehabilitation of three 'cattle passes' in the Adjacent Area of wetland PV-32.
  • Rehabilitation of two stream crossings in an unnamed tributary of the Wappinger Creek, NYS WIN H-101-6, Class C(t), within wetland PV-32 and its Adjacent Area.
  • Rehabilitation of two box culvert in an unnamed tributary of the Wappinger Creek, NYS WIN H-101-6, Class C(t) within the Adjacent Area of wetland PV-32.

Construction of parking areas adjacent to NYS Route 55 in Lagrange and adjacent to Lake Walton Road in East Fishkill are also proposed; both parking areas are outside of DEC wetland and stream jurisdiction.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has prepared a draft SPDES permit (SPDES# NY-0026433) and has made a tentative determination to approve an application by the Village of Montgomery for a SPDES Permit modification to expand its existing Wastewater Treatment Plant from the current 500,000 gallons per day (gpd) to a proposed 750,000 gpd, The plant currently discharges treated effluent to the Wallkill River, a Class "B" stream. The expansion would add or improve several components including a screening removal system, a grit chamber, an additional oxidation ditch and an additional chlorine contact tank. This expansion would meet the sanitary needs of approved projects and future development of undeveloped areas in the Village. The plant is located on 2.5 acres off Bachelor Street in the Village of Montgomery, Orange County, NY.

Article 19 Air Title V Facility

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to issue a minor modification to the LaFarge North America, Inc. Title V Permit. This facility is located in Buchanan, Westchester County, New York.

Lafarge is proposing a minor modification to their current Title V Permit to incorporate the following changes:

1. Replace the existing Raymond Mill (EU 17) with a new Landplaster Mill (LP Mill). The new LP Mill incorporates a low NOx burner rated at maximum heat input capacity of 0.7 mmBTU/hr.
2. Allow flexibility to use both Synthetic Gypsum and Natural Gypsum (as per set up prior to Ren 1 Mod 2).
3. Modify the permit to list the correct maximum heat input rating of the Calcining Mill burner at 111 mmBTU/hr. Current permit lists the maximum heat input capacity at 100 mmBTU/hr which was previously locked through software code according to Vendor's specification. The higher heat input will be required to accommodate the usage of Synthetic Gypsum in wall board manufacturing.
4. Modify the annual natural gas usage limit for the Calcining Mill (EU30), LP Mill (EU17) and Board Drier (EU38) to 2,125,790,000 Cubic Feet instead of the current value of 2,253,270,000 Cubic Feet. This decrease in annual natural gas usage will keep the NOx emissions unchanged at 40.15 tons per year as permitted in the pre-Ren Mod 2 Title V permit.
5. Quantify and incorporate a particulate emissions increase due to a material handling change in the plant.

This modification does not trigger any new regulations. Applicable State regulations include 6NYCRR Parts 201-6, 201-7, 211, 212, and Applicable Federal regulations include 40CFR 60 Part OOO.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
