Public Notice

The New York State Department of Environmental Conservation (NYS DEC) has determined that the Registry of Inactive Hazardous Waste Disposal Sites in New York State needs to be amended to delete site number 439003, known as the Butternuts Landfill. This site is located in the Town of Butternuts, within the County of Oswego, and is located at South New Berlin Road. The reason for deletion is:

When the site was first listed, potential contamination of the local groundwater and/or surface water sediments represented a significant environmental threat. PCB concentrations ranged from 4.7 and 520 ppm in the soils. Lead was also present at up to 4310 ppm.

An EPA soil removal cleanup completed in November 2003. End point soil samples taken post cleanup contained maximum concentrations of 1.1 ppm PCB, and 103 ppm of lead. There was some question regarding material EPA had used as backfill at the site, so NYS DEC took additional soil samples of that backfill in August 2008 revealing maximum concentrations of 1.4 ppm. Given the low levels of contamination remaining at the site, NYS DEC feels the site no longer presents a significant threat to human health or the environment. New York State Department of Health (NYS DOH) concurs with this assessment.

Schenectady County - The Town Board of the Town of Niskayuna, as lead agency, has determined that the proposed Medical Office Building will not have a significant adverse environmental impact. The action involves the construction of a 14,862 square foot medical office building on 2 ± acres of land. The project is located at Balltown Road and Reilly Way in the Town of Niskayuna, New York.
