Project Description:

The applicant proposes to develop and operate a new 9.54 acre surface sand and gravel mine. The project site is the Pompa property located on State Route 224 just outside and to the west of the Village of Van Etten. The mine is intended to operate as a traditional surface extraction of the Valois series of gravelly loams which is the predominate soil type on the site. Mining is not proposed for below the local water table. Mining will remove approximately 15,000 tons of aggregate material annually over the operational life of the mine for use by the Town for road maintenance and construction. This site has been previously mined at thresholds below that which requires a NYS DEC mining approval. Material will be stockpiled as unprocessed "run-of-bank", or processed with a portable screens and crusher. Maximum processing rates for the screen and crushing operations will not exceed 50 tons-per-hour. Final reclamation will restore the site to an open pasture/wildlife area with uniformly graded and revegetated open land including the replacement of stockpiled topsoil, and reseeding with an approved USDA SCS seed mixture. The reviewed Life-Of-Mine area is 9.54 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 01, 2009.

Project Description:

The Department has made a tentative determination to re-issue a previously expired SPDES permit for an existing sanitary system consisting of a UV light filter, septic tank/leachfield and sandfilter from a private residence with system with a design flow of up to 450 gallons per day to Canandaigua Lake. Based on the Applicant's observation, the effluent infiltrates into the subsurface soil with little surface discharge. As a tentative determination, the Department is seeking comments before issuing a final decision.
