The applicant proposes to construct a portion of an access road off Fair Streeet to serve a 50 unit townhouse development to be known as Pond View, across a narrow section of state regulated wetland LC-15 that will require 0.084 acres of wetland fill. The road will then continue into the development, affecting a portion of the wetland 100 foot adjacent area. In addition, approximately 0.314 acres of wetland will be affected as part of a proposed rehabilitation of the existing dam on the property. The applicant has proposed the creation of 0.46 acres of new wetland as mitigation. The project will be served by onsite central water and sewer systems. These systems will require modifications to permits previously issued by DEC to existing water and sewage works corporations. The water supply system will use three wells to supply an average of 14,400 gallons per day(gpd). Sanitary wastewater (16,900 gpd design flow) will be treated using two subsurface sanitary disposal systems. The project is located on a 90.5 acre property located on the east side of Fair street, approximately 2000 feet north of Fields Corners within the Towns of Kent and Patterson.

The Deforest Lake Filtration Plant serves Rockland County. The facility has a design flow of 20 mgd and has surface discharge into the Hackensack River, a class A water.
The following changes to the permit are proposed: permit pages and conditions have been updated to reflect current department guidance, format and nomenclature. Sludge from the dissolved air floatation process has been included as part of the wastewater type. The suspended solids limits are not based on a net value and the word net has been removed. Action levels for iron and copper were reduced to reflect the level of discharge. A short term, high intensity monitoring schedule has been added. A schedule of compliance for the Nalco polymer has been added describing the different options for the use of this polymer.

The Kauneonga Lake WWTP is a Publicly Owned Treatment Works, and serves the communities of White Lake and Kauneonga Lake, in the Town of Bethel, Sullivan County, with a design flow of 0.600 MGD. Treatment consists of aerated lagoons, settling, rapid sand filtration, ultra-violet light disinfection and post aeration. The facility has surface discharge into White Lake Brook, a class B water.

The following changes to the permit are proposed: The permit limits will continue with intermittent stream effluent limits as contained in the original permit which are protective of water quality. A requirement has been added for whole effluent toxicity testing, on a quarterly basis every 5 years, starting with 2010. The modification also includes several other minor reporting modifications.

The applicant proposes to dredge approximately 1800 cubic yards of sediment from a one-acre pond (Class B), and install a new 6-foot diameter culvert pipe within an unnamed tributary to the Neversink River (Class B) at the inlet to the pond in order to construct a driveway at the Menorah Congregation and Religious Center. A 1/3-acre area within the pond will be dredged to a depth of 4 feet; dredge spoils will be disposed of within the remaining 2/3-acre portion of the pond as fill, and will be vegetatively stabilized in place. Approximately 250 linear feet of stream channel will be restored and stream flow will be maintained by construction of a new 10-foot wide stream channel through the area of work. The project will impact a total of 430 linear feet of the unnamed tributary to the Neversink River. The project is located on the north side of Old Falls Road (County Route 53), 3000 feet east of Wartzman Road in the Village of Woodridge.

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to issue a new State Facility Permit for the operation of a 240 ton per hour batch mix asphalt plant and a mobile screening unit for the Liberty Asphalt Plant which is located in Liberty, Sullivan County. This State Facility Permit will replace existing certificates to operate. The asphalt plant will be permitted to burn number 2 oil, number 4 oil, waste fuel A (as defined in 6NYCRR Part 225-2), and natural gas. Electrical demands for the asphalt plant are supplied by utility line power. The screening unit includes a two deck screen and a crusher, and will be powered by a diesel generator.

Emissions of carbon monoxide and oxides of nitrogen (NOx) are each limited to 94.9 tons per year. This limit will keep the facility below major source thresholds, and thus the facility will not be subject to the requirements of Title V and 6NYCRR Part 212 NOx Reasonably Available Control Technology. The facility will track asphalt production and generator hours of operation on a monthly basis, in order to demonstrate compliance with the emission limits.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.
