Project Description:

Fulton County Regional Landfill is a 6 NYCRR Part 360 Permitted Landfill Facility operating under NYSDEC Title V Air Facility Permit ID No. 5-1728-00005/00006. This application is to renew the existing permit. The facility voluntarily operates a landfill gas collection and control system to combust landfill gas and destroy methane to reduce greenhouse gas emissions. The County is not required to install or operate the system at this time. Permitted emission units include 1-LFGAS. Existing permitted control devices include an active open utility flare and three (3) portable passive candlestick flares.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a Draft Permit and made a tentative determination to approve a State Facility Permit for the construction and operation of new semiconductor wafer fabrication clean room facility, as well as associated manufacturing space and support facilities.
Wafer fabrication processes are controlled by scrubbers or thermal oxidizers. These control devices keep emissions from those sources below major source thresholds and keep ambient air impacts below State guideline concentrations. Stack testing will be performed to confirm the effectiveness of these control devices. The permit also includes caps on emissions of Nitrogen Oxides and Sulfur Dioxide which are emitted primarily from boilers and emergency generators. These emissions are limited to not more than 90 tons per year for each contaminant which is below the major source limits.
The application, draft permit and relevant materials are available for review at the Warrensburg DEC office. Comments of support or objection may be made by filing a written statement prior to the comment deadline.

State Environmental Quality Review (SEQR) Determination:

A draft environmental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: Malta Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
