Debris removal will temporarily impact approximately .08 acre of Freshwater Wetland. An access road will be constructed and restored upon completion of the work. Access road construction will temporarily impact .22 acre of 100 foot adjacent area. A Timber Rattlesnake monitor will be onsite throughout construction to prevent an incidental taking of this NYS threatened species.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 6815) pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). As a result of comments received by the permittee, this is a re-notice of the Notice of Intent to Modify published in the Environmental Notice Bulletin on 1/21/09.

The Warex Cargo Terminal stores and distributes petroleum products. The terminal receives petroleum product via barge at the facility's off loading dock. The facility has a storage capacity of 19,826,470 gallons. The facility collects stormwater before discharging to the Hudson River, a class B water. Stormwater from the loading rack is treated by an oil separator and air stripper before discharge. This notice and draft permit corrects the error in the flow diagram and proposes to continue the current action level for effluent limits at outfall 001. An internal outfall (01A) with monitoring located after the air stripper has been added to the permit. Effluent monitoring and limitations for outfall 01A have been added to the permit.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003 0678), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The Sewer District #5-Hillsdale facility handles 27,200 gallons of sanitary wastewater per day from about 44 homes along Green Lane and Carey Street in City of Mahopac and serves 220 residents of those homes. The wastewater treatment system in the facility includes Septic tank, Bioclere Units, Chlorine Contact Tank.

The following changes to the permit are proposed: Updated permit pages reflect current DEC guidance, format and nomenclature. Based on technology based standards, the pH range at outfall 001 has been changed. The effluent disinfection requirement has been changed from all year to seasonal based on water quality standards. Monitoring for Total Phosphorus and Ammonia Nitrogen have been added. The total residual chlorine limit at outfall 001 was changed from a technology based limit to a limit based on a regulatory standard for protection of aquatic life. The existing limit will remain in effect as an interim limit until upgrades are completed in accordance with the schedule of compliance. A short term high intensity monitoring schedule for total copper and total phenol has been added. The facility has treated surface discharge into a tributary to tributary 2 of Osceola Lake, a class D water.
