Negative Declaration

Orange County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Herbicidal Treatment of the Invasive Species Tree of Heaven (Ailanthus Altissima) on Stewart State Forest will not have a significant adverse environmental impact. The action involves the application of the herbicide Glyphosate (Roundup Pro) to rid scattered sites of the non-native invasive, Tree of Heaven (Ailanthus altissima) throughout the Stewart State Forest. Early control will enhance the regeneration of native vegetation such as oak, hickory and maple. Glyphosate herbicide will be applied directly to the main stem of the target tree species (Tree of Heaven) using the "Hack and Squirt" method. The application would be performed in early fall to ensure that the Glyphosate is transported into the root system. It is the intention of Lands and Forests staff to treat all occurrences of this invasive plant on the property. Although infestations are heavy in certain areas, many occurrences are small and scattered. For this reason, the entire state forest is listed as the project area. This provides Lands and Forest staff the ability to apply a stem treatment of Glyphosate when and if a new occurrence is discovered. It is estimated that less than .01 percent of the forest (approximately 6 acres) of Stewart State Forest (6,700 acres) is comprised of Tree of Heaven (Ailanthus altissima). Repeat applications may be necessary over the next four years. If this State Forest is not treated then native plant communities will be jeopardized allowing non-native vegetation to continue to grow. This is contrary to the managment actions set forth in the Stewart State Forest Unit Management Plan. The project is located in the Stewart State Forest in the Towns of Montgomery, New Windsor and Hamptonburgh and the Village of Maybrook, near Newburgh, New York.

Ulster County - The Ulster County Legislature, as lead agency, has determined that the proposed Ulster Tomorrow: A Sustainable Economic Development Plan for Ulster County will not have a significant adverse environmental impact. The action involves the adoption by Ulster County Legislature of Resolution No. 42 (February 11, 2009) Ulster Tomorrow as a component of the Ulster County Comprehensive Plan pursuant to General Municipal Law Section 239-d. The project is located county wide in Ulster County, New York.

Positive Declaration and Public Scoping

Ulster County - The Town of Ulster Town Board, as lead agency, has determined that the proposed Zoning Amendment to Create OM-Office Manufacturing - Comprehensive Development Criteria may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until April 2, 2009. The action involves an amendment to the Town of Ulster Zoning Code to add a new section "OM-Office Manufacturing District - Comprehensive Development Plan" that would establish criteria and procedures for the Town Board to review and approve Comprehensive Development Plans (CDP) for certain properties within the OM District and provide a framework for their planned redevelopment over a period of years and to approve a CDP for the Tech City Site (consisting of the former IBM Manufacturing Site). The project is located town wide in the Town of Ulster, New York.

Notice of Acceptance of Draft GEIS and Public Hearing

Dutchess County - The Pine Plains Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Pine Plains Zoning Law and Zoning Map Adoption. Public hearings on the Draft GEIS will be held on April 18, 2009 at 9:30 a.m. and on April 22, 2009 at 7:00 p.m. both at the Pine Plains Lions Club Pavilion, 82 Beach Road, Pine Plains, NY. Written comments on the Draft GEIS will be accepted until the end of business on May 4, 2009 or up to ten (10) days following the close of the Public Hearing on the Draft GEIS, whichever is later. The zoning law and zoning map, and accepted Draft Generic Environmental Impact Statement are available for review at: http://pineplains-ny.gov/content/Generic/View/7. A public hearing on the Supplemental Draft GEIS will be held on May 11, 2009 at 7:00 p.m. at the Town of Wappinger Town Hall, 20 Middlebush Road, Wappinger Falls, NY 12590. Written comments on the Supplemental Draft GEIS will be accepted until May 22, 2009. A hard copy of the Supplemental DGEIS is available from the contact person listed below. Notice of Acceptance of Supplemental Draft EIS and Public Comment Period

Orange County - The Town of Goshen, as lead agency, has accepted a Supplemental Draft Environmental Impact Statement on the proposed Lone Oak Subdivision. Written comments on the Draft EIS will be accepted until March 30, 2009. The action involves the development of the Lone Oak Subdivision which has evolved over the years from 172 single family dwellings to a 299 unit Traditional Neighborhood Development on a 226.7 acre site. The current plans and related Supplemental Draft EIS are for 132 dwellings in a Traditional Neighborhood Development (TND) in the final sections, "C" and "D" of the Arcadia Hill Subdivision. Associated off site central water and sanitary sewage improvements, related utility and access easement areas are proposed within the 109.06 acre parcel (Lot 58) fronting on Harriman Drive which extends to the Village of Goshen. The project is located southeast of NYS Route 17, adjacent to the Arcadia Hills Subdivision and northwest of Arcadia Road in the Town-outside-Village area of the Town of Goshen, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Sullivan County - The Bethel Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Amendments to Zoning Map, Zoning Law and Subdivision Law. A public hearing on the Draft EIS will be held on April 15, 2009 at 7:45 p.m. at the Bethel Senior Center, 3594 Route 55, Kauneonga Lake, NY 12749. A hard copy of the DEIS is available at the address listed below. The online version of the DEIS is available at the following publically accessible web site: www.town.bethel.ny.us. The action involves the proposed amendment to Chapter 345 "Zoning" of the Town Code to implement fully the intent of the Town's Comprehensive Plan and the Town Board also needs to make minor changes to the subdivision law to implement fully the new zoning code and seeks to amend Chapter 300 "Subdivision of Land" of the Town Code. The project is located town wide in the Town of Bethel, New York.

Sullivan County - The Village of Bloomingburg, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Villages of Chestnut Ridge. Written comments on the Draft EIS will be accepted until April 12, 2009. The DEIS will be posted on the following website: www.chestnutridgeSEQRA.com. The action involves the Planned Unit Development application for a residential community on approximately 198 acres of land and will entail the construction of a community center, community park and a swimming pool. The project will also include the construction of 396 residential townhouse units.

Other improvements with the project include the construction of a new central water system, central sewer collection and conveyance system. Finally the project will require an upgrade and expansion of the existing Village of Bloomingburg Wastewater Treatment Plant (WWTP). The expansion will consist of the construction of a entirely new WWTP, which construction will be undertaken by the applicant and title thereto will be turned over to the Village of Bloomingburg upon its completion. The project is located on Winterton Road in Bloomingburg, New York.
