Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 3906), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

The addition of new Chesapeake Bay program monitoring limitations, summer Ammonia limit and Whole Effluent Toxicity testing action levels.

The modification also includes several other minor reporting modifications. The facility has surface discharge into the Cohocton River, a class C water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project Description:

This is a combined Notice of Complete Application for the proposed 2009 aquatic herbicide treatments in Waneta and Lamoka lakes for the control of the invasive plant Eurasian watermilfoil. This is the second year of a two-year treatment plan, which began in 2008. There are two sets of permit applications, one for each lake. For Waneta Lake the tracking application number is 8-9908-00171/00003 and for Lamoka Lake the tracking application number is 8-4434-00160/00003. The herbicide proposed for use is the liquid form of the active ingredient triclopyr, trademarked and sold as Renovate® 3, and the granular/flake form sold as Renovate® OTF. In Waneta Lake a total of +/-104.7 acres in 9 near shore, littoral zone locations will be treated, at preselected locations around the lake where severe nuisance concentrations of milfoil have been identified. Application rates will range between 2.0 and 2.25 ppm and will be monitored every two or three weeks until the triclopyr concentration drops to ≈1 ppb. In Lamoka Lake, treatment will be made on a total of +/-322.2 acres of littoral zone and shallow open water in 9 previously identified areas, primarily in the southern half of the lake. These will include the inner half of Fleet Cove, and the entire reach of Mud Creek to the Bradford Dam, including the whole of Mill Pond. Application rates will range between 1.0 and 2.25 ppm, and will be monitored in the same fashion as in Waneta Lake. Lake water levels will be drawn down before the treatment to allow treated water to be held within the lakes. Water monitoring will include a location in Mud Creek downstream of the Bradford Dam. Aquatic plant surveys will be conducted after treatment to establish and document the effectiveness of the treatment. Treatments are tentatively scheduled for the end of April 2009, or the beginning of May 2009, in both lakes. Copies of the application documents, maps and project plans are available for review at the town halls in the Town of Tyrone and the Town of Bradford, as well as at the DEC Region 8 office in Avon, NY.
