The project will result in 0.76 acres of permanent impacts to the 100' Adjacent Area of NYSDEC Wetland KE-4. This portion of the Adjacent Area has already been disturbed but will require some grading to accommodate the construction of the parking.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003 7397), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

The received water name has been updated and the classification has been upgraded to a Class C. The total residual chlorine (TRC) limit at outfall 001 has been changed from a technology based range to a limit based on a regulatory standard for TRC for protection of aquatic life. Monthly monitoring for total phosphorus, orthophospate, nitrate, nitrite and TKN, and quarterly monitoring for total dissolved solids has been added. The Delaware Basin Commission has been added as a recipient of Discharge Monitoring Reports.

The modification also includes several other minor reporting modifications. The facility has surface discharge into a tributary of Basher Kill, a class C water.

This proposal involves the construction of a 12' x 12' precast concrete storage shed, gravel access driveway and precast concrete boat ramp adjacent to East Boyds Road. Project Description:

The applicant proposes to regrade and restore an existing private access road and soil stockpile located within portions of Freshwater Wetland F-1 (Class I) and its 100 foot adjacent area. Activities proposed within regulated areas of the wetland include removal of debris, regrading of the access road and soil stockpile, replacement of an existing culvert with a new 12" diameter round HDPE pipe, repair of existing eroded areas, installation of new check dams, and revegetation of disturbed areas and areas of previous site disturbance. No new impervious areas are proposed; the width of the existing roadway will be reduced by this project. The total area of disturbance to the to the wetland is 0.04-acre; the total area of disturbance to the adjacent area of the wetland is 1.18-acre. Approximately 0.81-acres of disturbed area and previously disturbed area will be restored and revegetated at the project site as mitigation. The project is located on the north side of Fred's Way 500 feet west of Warren Street in the Town of Somers, Westchester County.
