The Village of Weedsport Wastewater Treatment Plant proposes to make upgrades to the plant, including the conversion of two (2) existing treatment tanks to sequencing batch reactors, construction of a new sequencing batch reactor, replacement of plant raw sewage pumps, construction of new rectangular cast-in-place concrete chlorine contact and sludge digester tanks, construction of a new equipment building to house aeration and sludge dewatering equipment, a new outfall pipe and headwall (located in the adjacent area of NYS DEC Freshwater Wetland W-23), and miscellaneous renovations in the existing control building.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination system (SPDES) Permit (NY-002 1466, DEC #7-0856-00011/00001) the Town of Sherburne, Chenango County, Village of Sherburne Wastewater Treatment Plant facility pursuant to 6NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

1. In accordance with New York State's Chesapeake Bay Tributary Strategy, action levels for total Nitrogen and Phosphorus and a compliance schedule requiring optimization of treatment for total Nitrogen and Phosphorus have been added to the permit. A monitoring requirement for Nitrite has also been added to the permit.
2. There is currently no effluent limit on mercury in the Sherburne Wastewater Treatment Plant permit. A 6-month long monitoring program for mercury has been added to the permit.
3. Administrative changes such as adding the "Discharge Notification Requirement's" pages to the permit are included.

Additional information including the current permit, and supporting documentation may be obtained from or inspected at the DEC's Cortland Office. Substantive comments on the permit or requests for a hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The Department issued a permit for this facility in January of this year that required certain action items that were included in a compliance schedule. The applicant proposes modifications to the compliance schedule. The applicant has requested an additional 30 days to submit engineering plans. The applicant also proposes 120 days be provided after department approval of the engineering plans to install declorination or an ultraviolet disinfection system and to install a flow meter.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the proposed modifications are considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
