Article 19 Air State Facility

Project Description:

The Department has received a request for a permit to construct and operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit, for the Hanson Watertown facility located at Black River Road; 25133 State Route 3; Watertown, New York 13601. This facility is applying for a state facility permit, to replace its current air facility registration to continue to process aggregate, lime, and hot mix asphaltic concrete at its currently permitted facility in Watertown, NY. The Standard Industrial Classification representative of this facility is 2951 & 1422.

Hanson operates H&B 5 ton hot mix asphalt batch plant and a portable 5-ton hot mix asphalt drum plant. Each plant, fires #2 fuel oil and/or waste oil, and includes a bag house control device. Each plant consists of a rotary aggregate dryer, elevator, hot screens, hot bins, weight hopper, mixer and truck load out station.

The facility has accepted a limit on the quantity of asphaltic concrete that it can produce during any consecutive 12 month period. Additionally the facility has accepted a limit on the number of hours that the diesel generators can operate during any consecutive 12 month period. By accepting these limitations the facility emissions for Carbon Monoxide (CO), Sulfur Dioxide (SO2), Oxides of Nitrogen (NOx), Volatile Organic Compounds (VOC), and Hazardous Air Pollutants (HAP) will be less than their respective major source thresholds. The facility must meet the sulfur in fuel oil limits of 6 NYCRR Part 225-1, the opacity and particulate emission limits of 6 NYCRR Part 212, the New Source Performance Standards for Non-metallic Mineral Processing Facilities of 40 CFR 60 Subpart OOO, and the New Source Performance Standards for Hot Mix Asphalt Facilities of 40 CFR 60 Subpart I, in addition to the operating limits mentioned above.

The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Apr 10, 2009.
