Project Description:

The applicant, owner/operator of Hillcrest Mobile Home Park, which is currently occupied by 35 mobile homes, has proposed to replace/upgrade the existing on-site waste water treatment plant with the construct of a new treatment system. Discharge through the system will require a new State Pollutant Discharge Elimination System (SPDES) permit for a daily average surface discharge of 8,000 gallons per day of treated sanitary wastewater, through a recirculating sand filter system with UV disinfection. The treated wastewater will discharge adjacent to the existing wastewater outfall location and flow into a drainage swale on the property and into a tributary (a class "D" water) of the Normans Kill. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System (SPDES) permit until Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 Office. SPDES #NY-0269018. The site is located on the north side of U.S. Route 20, approximately 1/4 of a mile east of the intersection of U.S. Route 20 and the I-88 interchange, in the town of Duanesburg.

Project Description:

The applicant proposes to construct a new 35,812 square foot Hanaford Supermarket with associated parking, drives and stormwater management area located on the north side of U.S. Route 20, approximately 600 feet west of the intersection with State Route 30, in the town of Duanesburg. The project will require a State Pollutant Discharge Elimination System (SPDES) permit for a new surface discharge with an allowable daily average of 3,050 gallons per day of treated sanitary wastewater, through an on-site pre-packaged wastewater treatment plant with disinfection. The treated wastewater will discharge into a surface drainage swale on the property, at a point located approximately 275 feet from the Schoharie Creek, which will then flow directly into the Schoharie Creek. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System (SPDES) permit until Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 Office. SPDES #NY-0269085. The project will also require a 401 Water Quality Certification permit from the Department (DEC application #4-4220-00221/00002) as a federal permit is required from the U.S. Army Corps of Engineers for the permanent filling of approximately 0.24 acres of federal jurisdictional wetlands and 190 linear feet of intermittent stream channel on the site. To compensate for the loss of wetlands, the applicant proposes to provide on-site wetland mitigation through the creation 0.48 acres of new wet meadow and will also protect the created wetland and remaining undisturbed on-site wetlands, in an undisturbed natural state in perpetuity, by placing these lands under a declaration of restrictive covenants. Though a preliminary determination of no effect on historic and/or archeologic resources has been provided by the NYS Office of Parks, Recreation and Historic Preservation (OPRHP), due to some remaining site survey work to be completed when the weather permits and some additional information to document potential effect on surrounding historic properties, a final review of all the data and recommendation of the NYS OPRHP is required. The project site is located on a +/- 58 acre parcel, of which approximately 6.6 acres will be disturbed as a result of this project.
