Draft Request for Proposals

Transfer, Haul and Disposal of Solid Wastes from the Town of Oyster Bay Solid Waste Disposal District Contract No. DPW09-999

Please take notice,
That pursuant to, and in accordance with, Section 120-(w)(4)(e)(2)(i) of the New York State General Municipal Law, the Town of Oyster Bay has issued a Draft Request for Proposals (DRFP) for the purpose of soliciting comments from prospective proposers and the public, with respect to the above specified Contract, prior to the issuance of a Final Request for Proposals. Said comments are to be made in writing and submitted to the Engineering Division of the Department of Public Works, 150 Miller Place, Syosset, New York 11791, no later than the close of business on Monday, May 18, 2009, at 4:45 p.m. Upon receipt of all comments, the Town of Oyster Bay may issue a Final Request for Proposals. Do not submit costs with the comments on this Draft Request for Proposals.

The Draft Request for Proposals is on file, and may be obtained daily (except Saturday, Sunday and Holidays) on or after Wednesday, March 18, 2009, between the hours of 9:00 a.m. and 4:45 p.m., at the Engineering Division of the Department of Public Works, 150 Miller Place, Syosset, New York 11791, by any interested persons. There is no fee associated with obtaining this document.

A copy of the Draft Request for Proposals is also on file, and may be viewed daily (except Saturday, Sunday and Holidays) between the hours of 9:00 a.m. and 4:45 p.m., at the Office of the Town Clerk, 54 Audrey Avenue, Oyster Bay, New York 11771.

A Group Site Visit and Comments Conference for prospective proposers is tentatively scheduled for Wednesday, April 15, 2009.

On January 27, 2009, the Town of Brookhaven awarded a Contract to Trinity Transportation Corp., pursuant to §120-w of the General Municipal Law (GML §120-w), for the operation of the Town's transfer station and the transportation of solid waste generated in the Town of Brookhaven for disposal.
The validity of this Contract or the procedures which led to its award may be hereafter contested only by action, suit or proceeding commenced within sixty (60) days after the date of this notice and only upon the ground or grounds that:

(1) Such award or procedure was not authorized pursuant to that Section; or

(2) Any of the provisions of that Section which should be complied with at the date of this publication have not been substantially complied with; or

(3) A conflict of interest can be shown in the manner in which the contract was awarded; or by action, suit or proceeding commenced on the grounds that such Contract was awarded in violation of the provisions of the Constitution.

Negative Declaration

Suffolk County - Suffolk County, as lead agency, has determined that the proposed Ocean Aviation Hangars will not have a significant adverse environmental impact. The action involves the proposed construction of 13 small aircraft hangars in two buildings for general aviation aircraft on approximately 3 acres in the northern portion of Francis S. Gabreski Airport. The project is located at the Suffolk County Francis Grabeski Airport on Old River Road (CR 31) in the Town of Westhampton, New York.

Notice of Acceptance of Final Supplemental EIS

Suffolk County - The Town of Brookhaven Town Board, as lead agency, has accepted a Final Supplemental Environmental Impact Statement on the proposed Condominiums at Sandy Hills. Copies of the Final Supplemental EIS can be obtained from the contact person listed below or it may be viewed on the Town's website at: www.brookhaven.org. The action involves an application for a change of zone from J-2 Business and A-1 Residence to J-6 Business and MF (Multiple Family) to develop 39.38 acres with 135 multiple family units (10% affordable) and 13,000 square feet of commercial use. The project is located along Route 25 in Middle Island, New York.
