Project Description:

The applicant has a permitted operation and has requested permit modifications to the Mine Operation Periods and to the Truck Routes permit conditions. The applicant proposes operating hours of Monday - Saturday from 6:00 a.m to 6:00 p.m. Operation would be prohibited on Sundays and certain legal holidays. The applicant also proposes that the Mine Operation Periods be waived in the event that the New York State Department of Transportation or other state or municipal entity requires the delivery of materials outside the permitted Mine Operation Periods. Tricity also requests a change in the permit condition that provides that loaded and empty trucks must use NYS Route 12 when traveling in the Town of Greene and that trucks must use the route through Brisben to and from NYS Route 12. Tricity's primary request for a modification to the permit condition is to have the permit condition language modified by adding "The permittee, through reasonable means, shall encourage customer and the other non-employee drivers to use the same route." to recognize that it has no real control over non-employee drivers to enforce the required route.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002-0958), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). As a result of comments received from the permittee, this is a renotice of the Notice of Intent to Modify posted in the Environmental Notice Bulletin on 12/29/08. In addition to those proposed changes in the 12/29/08 Notice, the following changes to the permit are proposed:

An interim limit of 0.5 for Phosphorous will be effective from the date of the start-up of the upgraded treatment system. The permittee is required to submit 12-month laboratory results. After the review and evaluation of the laboratory results, the DEC may revise the interim limit and include a technology based phosphorus effluent limit.

The facility has surface discharge into Cayuga Lake, a class A water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
