Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 026 1114), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

The permittee name has been changed from Delaware and Hudson to Canadian Pacific Railway. Outfall 001: Total Suspended Solids action level has been added. The action level for benzene, toluene and xylene has been changed. A short-term high intensity sampling program has been added for chromium, copper, mercury and zinc. Outfall 002: has been added.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into the Hudson River, a class C water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to modify an existing surface unconsolidated sand and gravel mined land reclamation permit to add 16.5 acres to the current 7.5 acre life-of-mine area for a total LOM of 24 acres. Current processing includes crushing and screen, additional processing to be added will be washing utilizing a "closed-loop" system. There is no dewatering proposed and no off-site discharge. There are no changes proposed to the level of activity or mining methods for the proposed expansion. The site is located on State Route 23 approximately 3/10ths of a mile east of County Route 10 intersection.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes a new discharge of 4880 gpd of treated sanitary waste to a tributary of Coxsackie Creek from a proposed restaurant on Route 9W, south of the Exit 21A interchange. The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought, or for the overall proposed project.
