Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 5835), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

The following has been added to the permit:

- Mercury Minimization Program requirements.
- A Quantification and Removal Study in response to reduced water quality based effluent limits for copper, iron, lead, nickel, and zinc.
- Water Treatment Chemical requirements.
- A Compliance Schedule requiring submittal of Water Treatment Chemical Usage Notification forms, and a short term monitoring program for several parameters.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into the Peconic River, a class C water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

Applicant proposes the removal of two existing buildings and construction of an equestrian center and boarding facility in the same general area, within the 100' adjacent area of NYSDEC regulated freshwater wetland(FWW) SJ-11. Also proposed is the removal of several paved and unpaved pathways and the construction of similar structures in various locations within the adjacent area. In addition, the protection and enhancement of the pond and wetland area is proposed with installation of several supplemental buffer areas planted with a variety of native species comprised of trees, scrubs, herbaceous plants and ferns. Also included is the construction of a berm area in the southwest and drainage improvements in the northeast portion of the adjacent area. The site is located at 604 Moriches Road, Nissequogue, Town of Smithtown, Suffolk County, SCTM# 802-12-1-3 & 13.6.
