Negative Declaration

Orange County - The Village of South Blooming Grove Village Board, as lead agency, has determined that the proposed Initial Adoption of First Zoning Local Law will not have a significant adverse environmental impact. The action involves the adoption of the first zoning Local Law on February 9, 2009, for the Village of South Blooming Grove, Incorporated in 2006. It includes Zoning Code, Zoning Map information and a map showing Overlay Districts. The project is located in the entire Village of South Blooming Grove, New York.

Positive Declaration

Sullivan County - The Town of Bethel, as lead agency, has determined that the proposed Zoning Code Amendment may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the amendment of a portion of the Zoning Code to comply with the Town's Comprehensive Plan. The project is located town wide in the Town of Bethel, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Orange County - The Town of Montgomery Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Beaver Dam Estates Subdivision. A public hearing on the Draft EIS will be held on March 9, 2009 at 7:30 p.m. at the Town of Montgomery Town Hall, 110 Bracken Road, Montgomery, New York. Written comments on the Draft EIS will be accepted until a minimum of ten (10) days after the close of the hearing. A copy of the DEIS is available on the following website: www.townofmontgomery.com.

The action involves the proposal to subdivide an approximately 161 acre parcel located in a County Agricultural District on Beaver Dam Road into 38 lots. Approximately 84 acres of the total parcel is located in what was designated as the RA-2 zoning district, but which has recently been reverted by court action to RA-3. The remaining lands are located in the OB District. The project has been designed in accordance with the RA-2 bulk and dimensional requirements. One of the proposed lots, Lot 23, is proposed to contain a total of 93.6 acres as protected agricultural open space, in addition to a dwelling. The residential lots will be served by individual wells and septic systems.

The Proposed Action is to be built in three phases:

1. The agricultural-residential Lot 23 and improvements to Beaver Dam Road.
2. Construction of Road B and Lots 1 - 30, except Lot 23.
3. Construction of Road A as an extension of Powers Lane and Lots 31 - 38.

The project is located at Beaver Dam Road and Powers Lane in the Town of Montgomery, New York.

Notice of Acceptance of Supplemental Draft EIS and Public Hearing

Rockland County - The Town of Haverstraw Planning Board, as lead agency, has accepted a Supplemental Draft Environmental Impact Statement on the proposed Minisceongo Park. A public hearing on the Supplemental Draft EIS will be held on March 4, 2009 at 8:05 p.m. at the Town of Haverstraw Town Hall, One Rosman Road, Garnerville, NY 10923. Written comments on the Supplemental Draft EIS will be accepted until 5:00 p.m. on March 16, 2009. A copy of the SDEIS may be obtained from the Town of Haverstraw, the Town Clerk's Office and Kings Daughters Public Library. Electronic copies of the SDEIS shall be posted on the following website: www.timmillerassociates.com/publicreview. The action involves the proposal to develop up to 254,000 square feet of commercial space within the Town of Haverstraw. Also proposed to be developed in the Town of Ramapo, up to 219 multifamily dwelling units and four (4) commercial pads totaling approximately 16,850 square feet of commercial space. The project is located on a 53.3 acre site, north of Route 202 and just west of the Palisades Interstate Parkway in the Town of Ramapo and the Town of Haverstraw, New York.
