Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 6859), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

Stormwater discharges have been included in the permit along with requirements for development of a stormwater pollution prevention plan. A schedule of compliance has been added to address development of a stormwater pollution prevention plan and to require a short term monitoring program for bis(2-ethylhexyl)phtahalate and butyl benzyl phthalate. Draft permit limits, action levels and monitoring for Outfall 001 have been changed as follows: Discharge limit for total residual chlorine was reduced. Discharge limit for cadmium was revised to a type II action level and reduced. Discharge limit for mercury has been added along with a mercury minimization program and routine monitoring. Action levels for trichloroethene, 1,2-dichlorobenzene, chloroform, 1,1,1-trichloroethane, bromodichloromethane and dibromochloromethane have been removed. Action levels for chromium, lead, toluene and tetrachloroethylene have been reduced and changed from type I to type II action levels. Action level for methylene chloride was changed from a type I to a type II action level. Action level for tetrachlorobenzene has been increased and changed from a type I to a type II action level. Sampling frequencies for nickel and zinc have been reduced. Action level for zinc has been increased. Toxicity testing requirements have been updated. Five point source stormwater discharges have been added to the permit and designated as outfalls 002-006. These discharges will be monitored twice a year. An action level for chemical oxygen demand has been included.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into the (outfall 001) Atlantic Ocean, a class SA water and (outfalls 002 - 006) a tributary to Cedar Creek, a class SC water.

DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The applicant proposes to reconstruct 91.5 feet of bulkhead in-place and construct 9.5 feet of new bulkhead to close off an existing boat slip. The applicant also proposes to dredge no further than 10 feet from the existing bulkhead to a depth of -4 feet below mean low water. Twenty-five cubic yards of dredge material and 15 cubic yards of fill material will be placed within the boat slip and behind the bulkhead as backfill. Filling of the boat slip will result in the loss of approximately 125 square feet of tidal wetlands known as littoral zone (SM/LZ). The project is located at 4 East Clearwater Road, Lindenhurst, Town of Babylon, Suffolk County, SCTM# 0100-189-04-56.

Project Description:

The applicant proposes a discharge of 860 gallons per day of untreated wastewater to groundwater from the high pressure di-ionized water rinse system and the di-ionizer at the applicant's facility located at 27 Industrial Blvd. Unit E, Medford. The applicant plans to operate a Superconducting Radio Frequency Cavity processing center. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought or for the overall proposed project. Project Description:

The applicant proposes to upgrade an existing 69 kV electric transmission line which involves reconductoring the line, and replacing 13 wooden poles with new larger steel poles along an existing Long Island Power Authority (LIPA) right-of-way which traverses South Haven Park. The upgrade is part of LIPA's effort to storm harden and hurricane proof existing transmission lines, and is part of a system upgrade to provide for increased load including transmission of power from the new Caithness Long Island Energy Center power plant in South Yaphank. Some cutting of vegetation and excavation in, and adjacent to, regulated freshwater wetlands is proposed to allow vehicle access and installation of the new poles. The project is located south of the Long Island Rail Road, and extends west of River Road to Upper River Road, South Yaphank, Town of Brookhaven, Suffolk County.
