New York State Drinking Water State Revolving Fund Intended Use Plan

Draft Amendment #2 to the Drinking Water State Revolving Fund Intended Use Plan issued September 30, 2008 was published in the January 14, 2009 issue of the Environmental Notice Bulletin. The comment period for the Draft Amendment #2 closed on January 29, 2009. The New York State Department of Health received no public comments pertaining to this amendment. Therefore, the amendment to the Drinking Water State Revolving Fund Intended Use Plan is final as shown below:

"The New York State Department of Health (NYS DOH) and the New York State Environmental Facilities Corporation (NYS EFC) amended the Drinking Water State Revolving Fund (DWSRF) Final Intended Use Plan (IUP) dated September 30, 2008 to adjust the estimated project cost for one DWSRF project listed on the Project Readiness List. The explanation of the reason for the cost revision is included in the table below:

Except for the above-noted change, there are no other changes to projects listed on the Project Readiness List or to the project priority rankings."

Announcement of Final Scope for Draft Supplemental Generic Environmental Impact Statement on the Oil, Gas and Solution Mining Regulatory Program

Well Permit Issuance for Horizontal Drilling and High-Volume Hydraulic Fracturing to Develop the Marcellus Shale and Other Low-Permeability Gas Reservoirs

The New York State Department of Environmental Conservation (NYS DEC or Department) is responsible for regulating the development and production of oil and gas resources in New York State. Natural gas exploration and production companies, and mineral rights owners, are interested in developing a potentially significant gas resource in the Marcellus Shale through the use of horizontal drilling and a hydraulic fracturing technique known as "slick water fracturing." This technique requires large volumes of water. The Department has identified the action of well permit issuance when high-volume hydraulic fracturing is proposed as one which requires further review under the State Environmental Quality Review Act (SEQRA).

On October 6, 2008 the Department completed the first step in that process by issuing the Draft Scope for the Draft Supplemental Generic Environmental Impact Statement on the Oil, Gas and Solution Mining Regulatory Program (DSGEIS). This draft scope was available for public review and comment thru December 15, 2008. During this comment period, the Department accepted written comments and held six public scoping hearings across the Southern Tier and Catskills to accept verbal comments. All comments received, including those submitted after the close of the comment period, were given equal weight and consideration in preparation of the Final Scope.

The Final Scope may be downloaded from the Department website at: www.dec.ny.gov/energy/45912.html. Copies are also available at the locations listed below under "Document Availability."

The Final Scope will serve as the outline and table of contents for the Draft SGEIS, which will also be made available for additional public review and comment upon its completion during Spring 2009. The final SGEIS, to be prepared after consideration of comments received on the draft, will set parameters for SEQRA review in addition to those established by the existing Generic Environmental Impact Statement (GEIS) on the Oil, Gas and Solution Mining Regulatory Program and its Findings. After it is finalized, the SGEIS will be applied in conjunction with the GEIS for gas well development using high-volume hydraulic fracturing.
