Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 026 8313), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

Effluent limits and monitoring requirements for barium, manganese and total chloride residual have been eliminated because the metals have been minimal in reporting. Chlorine is not used. Daily average effluent limit for iron has been eliminated. Quarterly sampling makes this unecessary. Decrease effluent limit for lead to reflect new water quality based effluent limit.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into a tributary to Lisha Kill Creek, a class C water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 06, 2009.

Project Description:

The Department has received an application from Bennington Paperboard Company, for a modification to an existing air pollution control permit for combustion units and process units located at the Bennington Paperboard Company, Route 67, Hoosick, Rensselaer County. This modification is being proposed by the permittee for the purpose of establishing certified emission reduction credits for reductions which were the result of shutdown of the emission sources at this facility. Bennington Paperboard will be establishing emission reduction credits of 65.4 tpy of N0x and 42.2 tpy of VOC's in accordance with 6 NYCRR Part 231 "New Source Review in Non-Attainment Areas" with this permit modification. The application (4-3828-00006/00008) is available for review at the Region 4 office. Comments will be received for 30 days from the date of this notice.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
