Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 0418), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). Additionally, the draft permit covers the permittee's request to incorporate a proposed process discharge (outfall 011) of approx 0.014mgd from a packed bed wet scrubber treating exhaust gases from a coal fired boiler. The following changes to the permit are proposed:

The current permit has an expiration date of 1/1/2020, which exceeds 5 years. This is not correct. The permit duration will be adjusted when this permit modification is issued. Outfall 001: -additional parameters for oil and grease, ammonia nitrogen, phosphorus, temperature, arsenic and copper have been added. A schedule of compliance to achieve ammonia limits is included. -the copper action level is based on an ingredient from water treatment chemical of AB Cutrine Plus. Outfall 002: -the schedule of compliance contains a requirement for sampling stormwater. Outfall IS3: -has been designated at this monitoring point to replace outfall 003 in the current permit. -a schedule of compliance to achieve total dissolved solids limit is included. -parameters from outfall 001 are required to monitor at this outfall. Outfall 009: -this is a new sanitary wastewater outfall to leachfield. No monitoring is required except flow. Outfall 011: -this proposed outfall will receive wastewater from a packed bed wet scrubber treating exhaust gases from a coal fired boiler. The permittee is required to submit an approvable engineering report for a proposed wastewater treatment plant ot achieve the discharge limitations in this permit. -there is a mercury limit of 50ng/l with a mercury minimization program requirement.

An updated monitoring location map and water balance diagram have been added. An updated water treatment chemical (WTC) page with approved WTC is included. Best Management Practices (BMP) plan requirements are included as well as a due date for the BMP plan submission. The schedule of compliance includes submittal requirements for reports, sampling results and plans. Discharge Notification Requirements have been added.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into Wolf Creek, a class C water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 27, 2009.
