Project Description:
The applicant proposes to cut a channel through existing gravel bars in Cold Creek (Class and Standard C) and place removed gravel bar material (approximately 3,800 cubic yards) along the creek's eroded banks. This is being proposed as a temporary measure to stabilize the banks that are eroding very close to the Town's water district well and pump house, the Town's park, homes and other facilities. The project site is located along an approximately 1,800 foot section of Cold Creek from a point approximately 720 feet upstream of NYS Rte 19 bridge over Cold Creek to the Cold Creek and Genesee River confluence.

The Department has prepared three draft Title V renewal permits and has made a tentative determination to approve these draft permits for the General Mills Operations, Inc. facility located near the intersection of South Michigan Avenue and Ganson Street in Buffalo, New York. General Mills Operations, Inc. is one Title V facility with three separate Title V permits: Cereal Plant (DEC No 9-1402-00565/00179), Co-Gen/Boiler House (DEC No 9-1402-00565/00177), and Flour Mill Plant (DEC No 9-1402-00565/00175). The renewal of the Title V permits will result in two major changes: 1) the addition of compliance assurance monitoring requirements in accordance with 40CFR64 at the Flour Mill Plant and 2) the addition of capping conditions limiting facility-wide individual and total hazardous air pollutant emissions to 9 tons per year and 24 tons per year, respectively to avoid the requirements of 40CFR63 Subpart YYYY- National Emission Standards for Hazardous Air Pollutants for Stationary Combustion Turbines and 40CFR63 Subpart DDDDD - National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers and Process Heaters.
In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
