Project Description:

The applicant proposes to construct a portion of a 336-unit, 15-building student housing complex within the 100-foot adjacent area of proposed State-designated Freshwater Wetland BR-5 and federally-regulated wetlands. The project site is located on about 29 acres located on the east side of John Street, accross from the intersection with Perkins Drive. As proposed, construction of stormwater management measures would impact approximately 2.35 acres of the state wetland adjacent area. In addition the project would require the discharge of fill into approximately 0.098 acres of federally-regualted wetlands, and the temporary disturbance of about 0.01 acres of federally-regulated wetlands for a utility line crossing.

Project Description:

The NYSDEC is pursuing a Department-Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) permit NY 002-5259, issued to the Village of Honeoye Falls Wastewater Treatment Plant pursuant to 6 NYCRR Part 750-1.18, NYS Environmental Benefit Permit Strategy (EBPS). The facility is permitted to discharge 0.6 million gallons per day of treated municipal wastewater to Honeoye Creek, a class B waterbody. The proposed changes to the existing permit are as follows:
Current BOD of 15 mg/l is being changed to summer CBOD limit of 13 mg/l and winter CBOD limit of 20 mg/l. This change from BOD to CBOD limits is an attempt to eliminate false test results. Monitoring will be done for Ammonia, Phosphorous, and TKN to provide background and to be consistent with other treatment plant permits. A requirement was added for Mercury minimization as part of the Pollutant Minimization Program in 40 CFR 132, Appendix F and TOGS 1.3.3 (available on our website at http://www.dec.ny.gov/docs/water_pdf/togs133.pdf).
The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
