Project Description:

Applicant proposes to operate a new 5 acre bluestone quarry on a 50 acre parcel of land. The applicant applied for and received a Bluestone Exploration Authorization in 2006 and renewed through July 2008. The bluestone will be recovered by blasting, then using wet saws and skid steers to remove the mineral from the site. The quarry is located on Honey Hollow Road, approximately .50 mile northeast of the intersection with Anne Road, Town of Windsor, Broome County.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The reactivation of a 9 acre surface unconsolidated sand and gravel mine on a 73 acre parcel. The proposed mine was formerly known as the Crane Farm Mine and was previously owned by Timothy Donnelly. The site is south of Town Line Road, east of Taylor Valley Road and west of NYS Route 26. Access will be off of Taylor Valley Road approximately 900 feet north of its intersection with NYS Route 26.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the New York State Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and has made a tentative determination to approve this application for renewal of an existing Title V permit for the operation of the Spear USA facility located at 6 Morrill Place, Fulton, NY. Spear USA operates a commercial printing facility producing flexible packaging materials. Some of the previously permitted activities have ceased at the facility. The Title V renewal permit reflects the current activities at the facility.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
