Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 020 6938), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

Redesignate outfall 001 as 01A, outfall 002 as 01B, outfall 003 as 01C, and outfall 004 as 01D; these are all internal designated monitoring points. Add references to new outfalls 002, 003 and 004. Designate outfall 001 as main final discharge to Black River. Add flow monitoring requirements and whole effluent toxicity action levels at outfall 001. Eliminate monthly average effluent limits at outfall 01A and 01C. The monitoring frequency of monthly does not allow for averaging. Add effluent limit and monitoring requirement for copper at outfall 01A. Lower effluent limit for iron at outfall 01A. Change effluent limit for chlorine residual at outfall 01B. Reduce effluent limits for copper and mercury at outfall 01C. Reduce action levels for benezene, ethylbenzene, toluene, and xylenes at outfall 01D. Add action levels and monitoring requirement for naphthalene at outfall 01D. Add reference to new outfall 002, 003 and 004. Add flow monitoring requirement at outfall 004. Add effluent and monitoring requirement for oil & grease at outfall 004. Add biological monitoring requirements, thermal study requirements and schedule of compliance. Redesignate internal monitoring points on flow diagram. Update Best Management Practices requirements. Add outfall locations maps, mercury minimization program requirements, and discharge notification requirements.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into the Black River, a class C water.

DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 20, 2009.
