Project Description:

Applicant proposes to renew and modify a permit for an existing pond expansion project located within Freshwater Wetland A-14. The project involves the excavation of humus from the wetland to increase the size and depth of an existing pond located on the Vita property, Karwacki Road, Town of Gallatin, Columbia County, New York. In addition to a Freshwater Wetlands Permit, a Mined Land Reclamation Permit is required due to the amount of material being excavated. The Life of Mine acreage is to be increased from 4.3 acres to 6.8 acres to include stockpile areas which are located outside of the current Life of Mine boundary and the wetland adjacent area. No other changes in the scope of the project are proposed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 026 1475), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

Eliminate effluent limits and monitoring requirements for Aluminum, Arsenic, Cadmium, Lead, and Zinc at outfall 001. The Discharge Monitoring Report and application data show deminimus levels. Update monitoring locations map. The modification also includes several other minor reporting modifications. The Facility has a subsurface discharge of 750 gpd.

DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The applicant proposes to discharge 10,500 gpd of treated sanitary wastewater through a septic tank/leach field system from the existing Schodack Plaza on Columbia Turnpike, in the Town of Schodack. The Department has made a tentative determination to reissue an existing permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 office.
