Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 6815) pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

The facility has undergone a major engineering design in which stormwater runoff is discharged into the Hudson River through outfall 001, eliminating outfalls 002 and 003. A settleable solid limitation was added to outfall 001 and a total suspended solids limitation was added to hydrostatic test water requirements. The action level for benzene, toluene, ethylbenzene and xylene was changed to a technology based effluent limit for an air stripper. The monitoring location page has been updated. A short term high intensity monitoring schedule for zinc has been added. Implementation of Best Management Practices plan has been added. Discharge Notification Act requirements have been added.

The modification also includes several other minor reporting modifications. The Facility has surface discharge into the Hudson River, a class B water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a modification and renewal in response to permit modification requests submitted by Metro-North Railroad Harmon Yard on 8/3/04 and 7/15/08. A revised State Pollutant Discharge Elimination System (SPDES) Permit has been proposed to address stormwater discharges from this facility. This modification is to address the facility and site stormwater management improvements conducted as part of the Harmon Shop Replacement Project and Wheel Truing Facility Project. Site stormwater improvements include installation of: -new stormwater infiltration trenches, -several new stormwater quality enhancement devices; -stormwater detention/recharge systems; -replacement of the existing oil/water separators with 4 new 50,000 gal separators; and, -replacement of the stormwater pump station. These improvements are expected to improve the stormwater quality by relocating railcar maintenance activities indoors and by improving the stormwater treatment capabilities.

The following changes to the permit are proposed:

Special Conditions-Industry Best Management Practices has been added. The discharge limit for zinc at outfall 002 has been reduced from 140 ug/l to the water quality based effluent limit of 100 ug/l. The discharge limit for copper at outfall 002 has been reduced from 100 ug/l to an interim limit of 63 ug/l. The department will evaluate 2 years of monitoring data following completion of the Phase II & III Harmon Yard improvements to determine if the water quality based effluent limit is achievable or implementation of a modified effluent limit should be considered. Action levels for antimony, bis(2-ethylhexyl)phthalate, methyl chloride, total phenolics and phenanthrene at outfall 002 are being discontinued as monitoring results have all been reported as non-detectable. Whole effluent toxicity testing for outfall 002 has been updated to reflect current requirements and will be used in conjunction with the interim copper limit. Outfall 003 have been deleted because operation of the remedial groundwater pump and treatment system was discontinued. Outfall 004 and outfall 005 have been added as a new outfalls at the north end of the facility. Monitoring of these outfalls for pH and oil & grease will be required.

The permit pages have been updated, renumbered, reordered and conditions reflect current department guidance, format and nomenclature.

The Metro-North Railroad Harmon Yard has surface discharge into the Hudson River and class SB water.

DEC seeks comments on this proposed regulated activity prior to making a final decision on permit issuance.

Applicant is proposing to modify the existing dock configuration to allow docking of oceangoing dry bulk material barges. Modifications include the addition of a crane platform for unloading, a new breasting dolphin for docking, modifications to three existing dolphins and modifications to an existing catwalk. Dolphins and crane platform will be supported by concrete filled pipe piles and rock sockets. No dredging is proposed with the modifications.
