Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY 020 0867, pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). As a result of comments received, this is a re-notice of the July 23, 2008 Notice of Intent to Modify posted in the Environmental Notice Bulletin on August 6, 2008. The proposed changes to the permit are as follows:

A review of detection levels for parameters suggests the laboratory cannot meet the proposed practical quantitation levels (PQL) due to significant interference in the effluent. Therefore, the permittee's PQLs to set compliance levels will be utilized. The sample type requirement in the short-high intensity monitoring program of the permit has been changed from flow-weighted to grab sampling. Construction activities related to the closure program are under coverage of the consent order, therefore, not required in the permit. However, a Notice of Intent and a Stormwater Pollution Prevention Plan are required for other construction activities. The SWPPP requirement for discharges of stormwater from construction activities has been modified so the differentiation between construction activities is clear. A condition has been added to footnote 2 of the permit. The permittee is required to submit an explanation when the Total Suspended Solids discharge level exceeds 100 mg/l.

The modification also includes several other minor reporting modifications. The facility has surface discharge into the Arthur Kill, a class SD water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
