Public Notice of Environmental Board Meeting
The New York State Department of Environmental Conservation (NYS DEC) hereby gives notice that a meeting of the Environmental Board will be held at 2:00 p.m., January 6, 2009, in Room 129 at the Department's main offices at 625 Broadway, Albany, New York.

The Board will consider the following rulemaking actions of the New York State Department of Environmental Conservation:

• Part 200, General Provisions,
• Part 201, Permits and Registrations, and
• Part 231, New Source Review for New and Modified Facilities

This meeting is open to the public.

New York State Drinking Water State Revolving Fund Intended Use Plan

Draft Amendment #1 to the Drinking Water State Revolving Fund Intended Use Plan issued September 30, 2008 was published in the December 3, 2008 issue of the Environmental Notice Bulletin. The comment period for the Draft Amendment #1 closed on December 18, 2008. The New York State Department of Health received no public comments pertaining to this amendment. Therefore, the amendment to the Drinking Water State Revolving Fund Intended Use Plan is final as shown below:

"The New York State Department of Health (NYS DOH) and the New York State Environmental Facilities Corporation (NYS EFC) amended the Drinking Water State Revolving Fund (DWSRF) Final Intended Use Plan (IUP) dated September 30, 2008 to adjust the estimated project costs for five DWSRF projects and to revise the project score for three DWSRF projects listed on the Project Readiness List. Project descriptions and explanations of the reason for the project cost revisions and scoring changes are included in the table below:

This amendment corrects this error, lists the final cost as $0, and increases the total project cost by $500 since the total short term financing was $13,960,500.

Added "NOTE: Short - Term Loan Closed, Project Cost Shown is Remaining Balance Not Funded With Short Term Loan". Project score changed on all applicable lists from 175 points to 1175 points.
Evans (T) Erie Consolidation with ECWA, extend system to serve area with private contaminated wells, remediate existing pressure problems. WD #5 Improvements and Extensions 15602 $12,900,000 $8,744,334 Amended to reflect short term Closing on 9/30/2008. Added "NOTE: Short - Term Loan Closed, Project Cost Shown is Remaining Balance Not Funded With Short Term Loan". Project score changed on all applicable lists from 140 points to 1140points.


The Department has determined that the project cost revisions and project scoring changes are necessary and reasonable. Although the project priority rankings were altered to accommodate the scoring revisions to three projects, these project changes will not adversely affect any other project on the IUP Project Readiness List above the funding line. Except for the above-noted changes, there are no other changes to projects listed on the Project Readiness List or to the project priority rankings."
