Project Description:

In conjunction with Trout Unlimited, the applicant proposes to control erosion of a tailings pile that was deposited on the bank/floodplain of Horton Brook during the construction of Air Shaft B to the Delaware Aqueduct which will also reduce sediment routing into Horton Brook, reduce aggradation, reduce the size of the chronic delta at the mouth of Horton Brook, and reduce the negative impacts of sedimentation on fish spawning and macroinvertebrate health downstream of the site. The project consists of recreating approximately 15,600 square feet of flood plain at Horton Brook by removing approximately 16,000 cubic yards of mining tailings from a 400 foot long section of the left bank of the stream, grade the streambank and plant trees and live stakes, and stabilize 300 feet of streambank using heavy stone rip rap. The project is located on Horton Brook Road approximately 1.3 miles north of Old Route 17.

Project Description:

The applicant proposes a maximum discharge of 450 gallons per day from an oil/water separator from existing truck storage building floor drains at the applicant's facility located at State Highway 10, approximately 1/2 mile east of Oxbow Hollow Road. The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under ARticle 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments ont he proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
