Notice of Waiver of RACT Requirements

Schonbek manufactures chandeliers with a variety of finishes. The chandeliers with highly reflective finishes use coatings which do not meet the volatile organic compound (VOC) content requirements of 6NYCRR Part 228. The Department has received and proposes to approve a request to extend, for 3 years, the existing waiver allowing the applicant to use coatings that do not comply with these volatile organic compound (VOC) content requirements. The company has provided documentation that compliant coatings which meet their specific requirements are not available and that the cost of installing a control device significantly exceeds the cost threshold for Reasonable Available Control Technology (RACT). The applicant has a State Facility Permit which caps VOC emissions below the major source level and has requirements which further restrict the amount of non-compliant coatings which may be used.

Negative Declaration

Saratoga County - The Board of Education of the Schuylerville Central School District, as lead agency, has determined that the proposed Independent Towers, LLC Telecommunications Facility will not have a significant adverse environmental impact. The action involves a Site Agreement between the Schuylerville Central School District and Independent Towers LLC, which would provide for (i) the lease by Independent Towers, LLC, of approximately 2,500 square feet of District property located near the existing bus garage on the main campus, and (ii) the construction thereon of a cellular communications service facility, consisting of a 100 foot tower, a base station, and related equipment. The project is located at 14 Spring Road in the Village of Schuylerville, New York.
