Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 023 4915, DEC 3-3346-00142-00001), for Stewart Airport pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

This is a re-notice to the 11/29/07 Notice of Intent to Modify posted in the Environmental Notice Bulletin on 12/19/07. The 11/29/07 Notice of Intent to Modify included proposed changes to the permit limits and monitoring section, addition of a best management practices requirement, and addition of compliance schedules. Subsequent to the 11/29/07 notice, the following changes are proposed:

MTBE will be removed from outfalls 004 and 011 as the aviation fuel stored on site does not and never did contain MTBE. Total suspended solids and biochemical oxygen demand for two de-icing seasons in the receiving waters of outfalls 001, 005, 008 and 013 will be monitored in order to provide data in determining limitations. In the meantime, the permitte will also monitor the effluent levels of those parameters. Upon review of the data, the DEC may determine that a limitation is necessary and may reopen the permit to add limitations.

Stewart Airport has the following surface discharges: Outfall 001 to Outfall 005 discharges to a Tribuary of Beverdam Brook, a class C water; Outfall 006 discharges to a Tributary of Beaverdam Lake, a class C water; Outfall 007 discharges to Crestview Lake, Tributary of Beverdam Lake, a class C water; Outfall 008 to Outfall 013 and Outfall 015, discharges to a Tributary of Moodna Creek, a class A water; and, Outfall 014 discharges to a Tributary of Silver Stream, a class C water.

DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 16, 2009.

Project Description:

This proposal involves the construction of two single family homes on adjoining lots to be served by a common driveway. The driveway will cross NYS Freshwater Wetland OL-3 (Class 2) in three separate locations via culvert crossings. Approximately 600 sq ft of disturbance is proposed to the wetland and approximately 4,000 sq ft of disturbance is proposed to the 100 foot adjacent area. Both homes will be constructed outside of the 100 foot adjacent area.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
