Negative Declaration

Allegany County - The Village of Cuba, as lead agency, has determined that the proposed Village of Cuba Wastewater Collection and Treatment Facilities Improvements will not have a significant adverse environmental impact. The action involves the lining or replacement of portions of the collection system, replacement of associated manholes, replacement of the primary treatment plant influent pump, trickling filter mechanism, clarifier and recirculation pump improvements, conversion of the existing anerobic digester to an aerobic process and other inkind repairs and improvements. The project is located at 17 East Main Street in the Village of Cuba, New York.

Erie County - The Town of Amherst, as lead agency, has determined that the proposed Site Plan for Asbury United Methodist Church will not have a significant adverse environmental impact. The action involves the proposal by the applicant, Uniland Development Co., 100 Corporate Parkway, Amherst, NY 14226, to construct a new Asbury United Methodist Church. A preliminary wetland investigation has identified 0.29 ± acres of federally jurisdictional wetlands on the site, in addition to a small undetermined amount of wetland jointly jurisdictional by the New York State Department of Environmental Conservation and the United States Army Corps of Engineers. The project is located at 850 Dodge Road on the northside approximately 300 ± feet west of Millersport Highway in the Town of Amherst, New York.

Erie County - The Town of Amherst, as lead agency, has determined that the proposed Site Plan Approval for Bryant & Stratton Educational Facility will not have a significant adverse environmental impact. The action involves the proposal by the applicant, Bryant & Stratton College, Inc., 2350 North Forest Road, Suite 12A, Getzville, NY 14068, to construct a one story, 29,000± square foot educational facility with two access driveways to Millersport Highway. The site measures 9.2 ± acres and is bordered on the north by Crosspoint Business Park. The southern and western portions of the site contain a federally regulated wetland and a portion of NYS Wetland CC-13. The project is located at 3650 Millersport Highway on the westside and approximately 130 ± feet south of its intersection with Crosspoint Parkway in the Town of Amherst, New York.

Notice of Acceptance of Final EIS

Erie County - The Town of Evans Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Site Plan Review of a Proposed Wal-Mart Retail Store. The DEIS is available on the following website: www.townofevans.org and is available from the Town of Evans Planning Office at 8787 Erie Road, Angola, NY 14006. The action involves the proposed construction of a 135,000 ± square foot Wal-Mart retail store with associated garden center, stormwater drainage and detention facilities, landscaping and parking on a 17 ± acre site. The subject property currently contains an abandoned drive-in theatre. The project is located at 9049 Erie Road (a.k.a. NYS Route 5) at the intersection of Lake Street in the Town of Evans, New York.
