Project Description:

The Town of Yates proposes to extend the water supply and distribution system of the District in its 4th application into Phase 8-9 and to take for use therein a supply of water estimated to average 6081 GPD and a maximum 6993 from the village of Lyndonville Lake Ontario source. Project includes the installation of 21,100 LF of 8" water main and appurtenances to serve 37 residential structures along Yates Carlton Townline Road, Alps Road, and East Yates Center Road. Project Description:

Steuben County has submitted an application for the renewal of the Title V Air Facility Permit for air pollution processes at the New Bath Landfill located on Turnpike Road in the Town of Bath. This renewal also includes two minor modifications to add a portable passive candlestick flare and to remove Emission Unit 3-LCHST. The proposed flare will not be a major source of emissions. Emission Unit 3-LCHST is now used for emergency leachate storage only and emissions are expected to be trivial.

The Title V Facility Permit was originally issued February 13, 2004 and no modifications have been issued since then. Control devices at this landfill currently include one large landfill gas flare and two smaller passive candlestick flares.

The Department has prepared a draft permit and has made a tentative determination to approve this application.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

An application has been received by the Department for an initial Title V Air Facility permit for a proposed landfill gas to energy facility adjacent to the New Bath Landfill on Turnpike Road in the Town of Bath. The proposed facility will have three Caterpillar G3520 engines/generators that will be fueled by landfill gas and will generate approximately 4.8 MW of electricity. Emissions from the proposed facility include oxides of nitrogen, sulfur dioxide, carbon monoxide, particulate matter, non-methane organic carbons, volatile organic carbons and hazardous air pollutants. The applicant proposes to include federally enforceable permit conditions which will limit or cap emissions of carbon monoxide below 250 tons per year (Prevention of Significant Deterioration threshold under 40 CFR 52.21) and emissions of oxides of nitrogen below 100 tons per year (New Source Review threshold under 6 NYCRR Part 231).

The Department has prepared a Draft Permit and has made a tentative determination to approve this application.
