Project Description:

Proposed construction of an approximately three foot high, 123 foot long seawall to control erosion along the shore of the St. Lawrence River. The seawall will be made of concrete blocks topped with a concrete slab to form a walkway. Rip rap stone on non-woven geotextile fabric will be placed at the base of the wall.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Repair the existing 125' long rock breakwater by adding 450 cubic yards of rip-rap to the top of the structure with the rip-rap being placed in a 125' long x 22' wide x 8' high section of the breakwater located in Sawmill Bay, Lake Ontario at 27300 Independence Point Road.

The applicant proposes to renew a permit to apply the herbicide Roundup between rails and ties of a railroad spur at their facility located approximately 2500' west of the Village of Gouverneur, and to include 1/3 ounce of the herbicide Oust per acre to be applied to the edge of the rail spur ballast. The site is located in the adjacent area of regulated freshwater wetland GO-4, a 46 acre Class III shrub wetland.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 0540), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The following changes to the permit are proposed:

Add effluent limits and monitoring requirement for lead. Delete action level and monitoring requirement for endothall (no longer used) and manganese (de minimus levels). Add Whole Effluent Toxicity action levels and monitoring requirements at outfall 001 and 003. Update Best Management Practices requirements. Add PCB Minimization Program requirements and update Water Treatment Chemical Requirements usage.

The modification also includes several other minor reporting modifications. The facility has surface discharge into the Raquett River and the St. Lawrence River, a class B and a class C water, respectively. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
