Pursuant to the Environmental Conservation Law sections 11-0303, 11-0307, 11-0903, 11-0905, 11-0909, 11-0917, the New York State Department of Environmental Conservation hereby gives notice of the following:

Notice of Adoption to amend 6 NYCRR section 2.3 pertaining to Migratory Game Birds. This notice will be published in issue 49 of the State Register, dated December 3, 2008.

The New York State Department of Environmental Conservation (NYS DEC) is making available the Division of Water Technical and Operational Guidance Series (TOGS) No. 1.1.6 Interpretation Guidance For Marine Dissolved Oxygen (DO) Standard. The primary purpose of this document is to provide guidance for interpreting compliance with the recently revised chronic DO standard for Class SA, SB and SC waters.

Municipalities and Owners/Operators of Public Drinking Water Supply Systems

New York State Drinking Water State Revolving Fund Intended Use Plan

The New York State Department of Health (NYS DOH) and the New York State Environmental Facilities Corporation (NYS EFC) propose to amend the Drinking Water State Revolving Fund (DWSRF) Final Intended Use Plan (IUP) dated September 30, 2008 to adjust the estimated project costs for five DWSRF projects and to revise the project score for three DWSRF projects listed on the Project Readiness List. Project descriptions and explanations of the reason for the cost increases and scoring changes are included in the table below:

Added "NOTE: Short - Term Loan Closed, Project Cost Shown is Remaining Balance Not Funded With Short Term Loan". Project score changed on all applicable lists from 140 points to 1140points.


The Department has determined that the project cost increases and project scoring revisions are necessary and reasonable. Although the project priority rankings were altered to accommodate the scoring revisions to three projects, these project changes will not adversely affect any other project on the IUP Project Readiness List above the funding line. Except for the above-noted changes, there are no other changes to projects listed on the Project Readiness List or to the project priority rankings.

Written statements or comments on the above DWSRF project scoring revisions and project cost increases will be accepted by fax or mail until close of business on December 18, 2008 and should be filed with:
