The applicant proposes varied disturbances to NYS Freshwater Wetland (FW) DP-1, Class II, and its 100-foot regulated Adjacent Area (AA) in association with the development of a 7-lot residential subdivision. Activities include:

  1. Widening of an existing trail to a 16-foot wide common drive serving 2 homes outside the regulated area. Distance includes approximately 60 linear feet of FW and 280 linear feet AA.
  2. Construction of approximately 140 feet of new 16-foot common driveway within the AA
  3. Restoration and re-vegetation of approximately 460 feet of existing trail
  4. Installation of a gate on an existing trail in the AA to limit access to portions of the property to be conveyed the town for open space preservation
  5. Installation of a 60 foot long, 12 inch diameter drainage pipe in the AA and construction of 2 rain gardens in the AA for control and treatment stormwater runoff from the common drive.
  6. Installation of a well in the AA to serve a single home outside the regulated area.

Project Description:

This proposal involves a four lot subdivision of 138 acres. Three residences are to be constructed and accessed via common driveway, which is to cross portions of 2 Federal Wetlands, a portion of NYS Freshwater Wetland MB-45 (Class 2), and a sub-tributary to the East Branch of the Wappinger Creek [Index # H-101-21-6-1-a, Class B(t)]. The proposed common drive is 16 feet wide (minimum width required by the Town of Washington for a common drive) and will cross approximately 100 feet of Federal Wetland, 110 feet of NYS Freshwater Wetland and 200 feet of 100 foot adjacent area, resulting in impacts to .06 acre of Federal Wetland and .2 acre of adjacent area. The road will cross the stream and a portion of NYS Freshwater Wetland utilizing an 85 foot span timber bridge supported by timber piles, therefore reducing NYS Freshwater Wetland impacts to approximately .01 acre.

This proposal involves the placement of approximately 600 cubic yards of bank run gravel on an existing 12' wide x 600' long road, which provides access to an existing lot. The existing road passes through approximately 175 feet of NYS Freshwater Wetland WL-29 (Class 2) and 300 feet of 100 foot adjacent area. The purpose of the resurfacing is to improve access to the parcel for potential sale. Also proposed is the replacement of a deteriorated culvert and the installation of a second 15" diameter culvert, to pass the wetland beneath the access drive.
