Project Description:

In Manhattan County, improve the mooring and berth facility at the US Coast Guard Battery Building (One South Street, NY, NY 10004), by dredging approximately 5,500 cubic yards of sediment, constructing a turning dolphin, installing a fendering system, and adding scour protection to Pier C. Dredged material to be disposed of at an upland location.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department is proposing to undertake a Department Initiated Modification for the SPDES permit for the Charles Poletti Power Project (Poletti). Poletti is an 885 MW natural gas and oil fired electric generating facility located in Astoria, Queens. The permittee requested that the Department delete all reference in the permit to federal 316(b) Phase II rule that was remanded back to the U.S. Environmental Protection Agency by the federal court. Based on this request the Department is also removing all biological monitoring conditions that the permittee has complied with at this time. In addition, the Department is also proposing to include a special condition that reflects the Joint Settlement Stipulation for the Article X proceeding for the Poletti Station Expansion (Case 99-F-1627) and remove any additional cooling water intake structure modification requirements. The Article X certificate and Joint Settlement agreement, issued October 2002, required the Poletti station to cease operation no later than February 1, 2010. The new special condition in the SPDES permit requires that if the Order is amended, the Permittee must seek a modification of the SPDES permit to continue operation.

SEQR Lead Agency: None Designated

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
