Project Description:

The applicant proposes to install a drop inlet and stormwater drain to relieve ponding problems of stormwater runoff along the south side of County Road (CR) 60. The proposal will include installing a catch basin inlet and approximately 360 ft. of drainage pipe to collect stormwater and to convey it under CR 60, discharging to the Allegheny River. The stormwater discharge outlet will consist of a concrete headwall and a rock-lined splash pad. A portion of the proposal is located within the regulated 100-ft. wide adjacent area of State Freshwater Wetland KC-15. As mitigation for the temporary wetland adjacent area disturbances, the applicant proposes constructing a 0.2 acre pothole within the Wetland KC-15 to enhance the wetland. The project site is located along CR 60 between Klice Cross Road and County Road 19.

The applicant proposes to expand an existing parking lot and construct stormwater detention ponds in a regulated freshwater wetland. Approximately 0.87 acres of wetland will be filled by the construction. The Department has determined that the weighing standards of Article 24 have been met through avoidance, minimization of impact, mitigation and the lack of a practicable alternative. Mitigation is proposed within the same watershed at 3679 East Blood Road in the Town of Marilla and and will consist of the creation of 1.74 acres of emergent wetland at a mitigation ratio of 2:1.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 7979), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The following changes to the permit are proposed:

Outfall 001: Settleable solids has been revised based on DEC guidance and the facility's Discharge Monitoring Report (DMR) data. Quarterly monitoring data for Total Nitrogen shall be reported. Total Phenolics has been revised to a water quality based effluent limitation from current action level. Action levels for nickel and zinc have been increased based on the DMR data. Based on EPA method 1631, mercury is not included in the draft permit. Whole effluent toxicity testing (WET) is revised to quarterly testing for one year and the permittee shall repeat the quarterly WET testing on every fifth year.

The Capacity, Management, Operation and Maintenance (CMOM) has been added. The Schedule of Compliance includes submission of: A flow study to evaluate the maximum flow that can be treated at the secondary treatment process; Short-term high-intensity sampling program for cyanide and mercury; A CMOM program; Annual bypass report; and, Wet weather operating report. Discharge Notification Requirements have been added. The modification also includes several other minor reporting modifications.

The Niagara County Sewer District #1 Water Pollution Control Center has surface discharge into the Niagara River - East Branch, a class A-special water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
