Project Description:

Applicant is proposing to dredge accumulated silt and sediment from from an existing instream pond of Ferguson Brook (NYS Water Index # H-171-17-16, Class Ct) located entirely within the applicants property. No work will be conducted in flowing water. All dredged material will remain onsite and be immediately stabilized.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 010 8324, DEC Identification #:3-5542-00029/00002), the Ossining Wastewater Treatment Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

Whole Effluent Toxicity testing requirement has been added. Development and implementation of a stormwarter pollution prevention plan has been added. Outfall 002 has been added and designated as a stormwater outfall. The total residual chlorine at Outfall 001 was given an existing maximum limit of 2.0 mg/l. Action levels for antimony, chromium, copper, lead, nickel, siver, zinc and chloroform has been adjusted. The mass limits for carbonaceous biochemcial oxygen and total suspended solids were rounded to 2 significant figures in compliance with DEC guidance. Toxicity testing requirements and a toxicity testing footnote have been added to the permit limits and monitoring page. The permit also includes the following requirements: an effluent limit of 50 ng/l; a mercury minimization program requirement; and, routine monitoring using EPA method 1631 or 245.7. A compliance schedule has been added for Chemical Oxygen Demand analysis for stormwater discharge and a short-term hi-intensity monitoring program. The modification also includes several other minor reporting modifications. The Ossining Wastewater Treatment Plant has surface discharge into the Hudson River, a class SB water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
