Permit(s) Applied for:

Article 19 Air Title V Facility

Project is Located:

Bronx, Bronx County

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Permit modification for a prison facility on Rikers Island seeking a variance from NYCRR Part 227-2 NOx RACT limit for 15 engines which are permitted to participate in the CDRP/PLM program. The applicant submitted a NOx RACT analysis dated 6/11/08 and demonstrated that the applicable presumptive NOx RACT emission limit of 2.3 grams/bhp/hr is not economically feasible for their engines. The proposed alternate NOx emission limits have been approved by the department and also is to be approved by EPA as a revision to the State Implementation Plan. The modified draft Title V permit has alternative engine NOx emissions limits with the requirement to perform a stack test once during the permit term. The total annual NOx emissions of these engines are limited to 22.5 tpy.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
